Article 1 : Application
1.1 - These general conditions of sale govern, exclusively, the contractual relationship between CHAMPAGNE BERNARD NJANDJA (hereinafter referred to as CHAMPAGNE BERNARD NJANDJA), and any person (hereinafter referred to as the "customer") who makes a purchase on the website (hereinafter referred to as the "site") via the following address: champagne-bernard-njandja.fr

1.3 - These general terms and conditions are applicable to all items offered for sale on the site and are reserved for customers over the age of 18 years who have full legal capacity.
1.4 - Any order of one or more items listed on the site implies the consultation and acceptance by the customer of these terms and conditions as well as the applied tariffs. These terms and conditions shall prevail over any other document as well as the terms and conditions of the customer's country.
1.5 - Any failure on the part of CHAMPAGNE BERNARD NJANDJA, to comply with any of the obligations outlined in these terms and conditions, shall in no way be interpreted by the customer as a waiver of the general terms and conditions of sale.
These terms and conditions may be subject to updates or changes without notice. The applicable conditions will then be those in force at the time of the conclusion of the contract, i.e. on the day the order is made.
Article 2 : Information concerning Items
2.1 - Items and promotions on the site are offered for sale within the limits of available stocks and in the case of promotions, until the end of their validity. The presence of an article on the website does not guarantee its availability in stock.
2.2 - All items offered for sale on the site are reserved for individuals.
2.3 - The photographs and texts illustrating the items are for information purposes only and are not contractual. Therefore, although represented on the site with the greatest precision, photographs and texts may contain errors. In this case, CHAMPAGNE BERNARD NJANDJA cannot be held liable.
Article 3 : Ordering Items
3.1 - Orders are placed on the site at the following address: champagne-bernard-njandja.fr
Items offered for sale are subject to availability. In case a product becomes unavailable, the customer will be informed after placing an order, by e-mail or mail. The order will only be confirmed once the customer has paid the order amount in full. CHAMPAGNE BERNARD NJANDJA reserves the right to refuse orders that are deemed invalid.
3.2 - Validation of the order :
If the customer wants to purchase one or more items, they should select a model or reference number, define the quantity, and then click on "add to cart". Article 4 : Price of Goods
The prices indicated on the site are in Euros and inclusive of all taxes (French VAT). Any changes to the rate of the French VAT will be reflected in the price of the products presented on the site.
Prices do not include postage and packaging which are charged to the customer and will be specified during the placing of the order.

Article 5 : Payment and Security
To settle an order, the customer will have the choice between the following methods of payment:
- Payment by credit card (unless the server is unavailable)
- Payment by bank transfer (if available and displayed on the website)
- Payment by cheque (if available and displayed on the website)
5.1 - Arrangements for payment by credit card :
The customer can pay for purchases directly on the site. The amount of the order will be charged at the time of confirmation. Payment by credit card is secured by an encryption system, therefore CHAMPAGNE BERNARD NJANDJA does not have access to the card number of the customer which is processed confidentially. Only national bank cards will be accepted by the security system as well as Visa, Eurocard and Mastercard.
5.2 - Arrangements for payment by Bank transfer :

The customer can pay for purchases by Bank transfer. The latter must indicate the Order Numer on the Bank transfer. Banking details of CHAMPAGNE BERNARD NJANDJA will be sent by email after validation of the order.
5.3 - Arrangements for payment by Cheque :
The customer can send a cheque by mail, payable to CHAMPAGNE BERNARD NJANDJA, accompanied by a photocopy of the passport or identity card of the customer to the following address: 7T Avenue Robert Schuman 51100 Reims
The cheque will be deposited in the bank upon receipt.
For all methods of payment, the amount of purchases must be paid in full and on the day of the order. Orders will be validated and processed, after payments are accepted by the banks involved (for payments by credit card, Visa, Eurocard, Mastercard) or upon receipt of payment (for bank cheques).
In the case of a payment dispute with a customer, CHAMPAGNE BERNARD NJANDJA reserves the right to refuse the order.
Article 6 : Delivery
6.1 - Method of transportation :
Orders can be shipped anywhere in the world. CHAMPAGNE BERNARD NJANDJA reserves the right to choose the appropriate mode of transport. Orders will be delivered in France by Colissimo or another operator.
6.2 - Delivery of products will be effective upon receipt of the total amount of the order. The products will be delivered to the address specified by the customer when placing the order. Consequently, the information provided by the customer is considered to be accurate and is not, in the case of a dispute, the liability of CHAMPAGNE BERNARD NJANDJA. In the absence of the customer upon delivery, the carrier will leave a notice at the address indicated.
6.3 - The average delivery time is 3-4 days. It is indicated only for guidance and does not constitute a commitment on our part.
6.4 - Delivery outside France :
The shipping amount quoted when placing an order applies to deliveries in mainland France. Delivery rates outside mainland France will be calculated as soon as the customer has indicated which country they require delivery to.
6.5 - A space on the site is devoted to tracking your orders, we invite you to visit it regularly.
6.6 - Reception of products :
It is recommended that the customer verifies the condition of goods ordered before signing the delivery note. Once the order has been signed, CHAMPAGNE BERNARD NJANDJA considers that the client has carried out this verification.
Article 7 : Right of Refusal
7.1 - Under the provisions of Articles L.121-20 and following the Consumer Code, the customer has a period of seven days from the date of receipt of the order to exercise their right of refusal without having to give reasons. The shipping fees for delivery and return will be charged to the customer. Refunds will be made by crediting the customer’s credit card within ... days. In case of return of a damaged, incomplete or spoiled product, it will not be exchanged or refunded.
Article 8 : Compliance and Product Warranty

8.2 - Guarantees
The customer benefits from the legal provisions relating to the guarantee of hidden defects under Article 1641 et seq. of the Civil Code.
Article 9 : Property and Termination Clause
9.1 - The ordered products remain the property of CHAMPAGNE BERNARD NJANDJA, until the customer meets their obligations, in particular that full payment is made. Once ownership has been transferred, the risk of loss, theft or deterioration of the products are the responsibility of the customer.
9.2 - In case of failure on the part of the customer of any of their obligations, the sale will be terminated automatically and without notice. Items must be returned to CHAMPAGNE BERNARD NJANDJA within 48 hours.
Article 10 : Personal Information
10.1 - The customer expressly agrees to provide CHAMPAGNE BERNARD NJANDJA with personal data so that we can better manage the order, delivery and customer relationships.

These terms and conditions are written in the French language and are governed by French law. In the event of a dispute between the parties, the court with territorial jurisdiction will be the Commercial Court of France.
